UAE Labour Law (Federal Decree-Law No. 33) Gratuity Rules Explained

1. Is gratuity calculated on basic salary or total salary?

Under Article 51 of UAE Federal Decree-Law No. 33 of 2021, end-of-service gratuity is calculated solely on the Basic Wage (the basic salary specified in your MOHRE employment contract). Housing allowances, transport allowances, overtime, performance bonuses, and medical benefits are strictly excluded from the calculation.

2. What if I worked less than 1 full continuous year?

An employee is legally entitled to end-of-service gratuity only after completing at least one full continuous year of service with the employer. If you leave or are terminated before completing 365 days, statutory gratuity entitlement is AED 0 (though you are still entitled to accrued unpaid wages and annual leave balance).

3. Does resigning reduce my gratuity payout under the new law?

No. Under the current UAE Labour Law, the old rules regarding unlimited contracts and resignation deductions (where payouts were reduced by 1/3 or 2/3) have been completely eliminated. All private sector employees are on fixed-term contracts. If you resign after completing 1 year of service, you are entitled to 100% of your accrued statutory gratuity.

4. When is the employer legally required to pay the final settlement?

Under Article 53, the employer must pay all wages, end-of-service gratuity, and accrued annual leave cash settlements within 14 calendar days from the termination or expiration date of the employment contract. Failure to pay within 14 days permits the worker to file a formal MOHRE labour grievance.

5. What is the maximum statutory cap on UAE gratuity?

By law, total end-of-service gratuity payout cannot exceed two years' basic salary (24 months of basic wage), regardless of how many decades the employee worked at the company.
