UAE Overtime Pay Rules & Working Hours (2026): Exact Labour Law Calculation

If you work more than 8 hours per day in the UAE, you are legally entitled to statutory overtime compensation under Article 19 of Federal Decree-Law No. 33 of 2021.

Many private-sector employees in Dubai, Abu Dhabi, and the Northern Emirates remain unaware of how overtime pay is computed or mistakenly believe overtime applies to their total gross package.

Under UAE Labour Law, overtime is governed by precise statutory percentages, mandatory night shift premiums, and a 2-hour daily ceiling. Here is how the law works and how to compute your exact payout.

1. Standard Working Hours: Article 17 Baseline

Before calculating overtime, establish your regular baseline hours under Article 17:

  • Standard Maximum: 8 hours per day or 48 hours per week (typically 5 or 6 working days).
  • Ramadan Reduction: Working hours are reduced by 2 hours per day for all private-sector employees, regardless of religion.
  • Commute Exclusion: Travel time between your residence and the workplace is not counted toward working hours.
  • Break Entitlements: Employees cannot work more than 5 consecutive hours without at least a 1-hour rest/meal break.

2. The Overtime Pay Formulas: Article 19

Overtime compensation is calculated strictly on the employee's Basic Salary, not the total package.

Under MOHRE guidelines, the monthly basic wage is divided by 30 calendar days and 8 standard hours per day (a standard 240-hour monthly divisor):

$$\text{Basic Hourly Wage} = \frac{\text{Monthly Basic Salary}}{240}$$

3. Real-World Overtime Calculation Example

Consider an employee with the following compensation terms:

  • Monthly Basic Salary: AED 12,000
  • Monthly Housing Allowance: AED 6,000
  • Total Gross Package: AED 18,000
  • Overtime Worked This Month: 12 hours daytime, 6 hours night shift, 8 hours on a rest day.

Step 1: Compute Basic Hourly Wage

$$\text{Basic Hourly Rate} = \frac{\text{AED } 12,000}{240} = \text{AED } 50.00 \text{ / hour}$$

Step 2: Compute Overtime Premiums

  1. Daytime Overtime (12 hours × 125%): $$12 \times (50.00 \times 1.25) = 12 \times 62.50 = \text{AED } 750.00$$
  2. Night Shift Overtime (6 hours × 150%): $$6 \times (50.00 \times 1.50) = 6 \times 75.00 = \text{AED } 450.00$$
  3. Rest Day Overtime (8 hours × 150%): $$8 \times (50.00 \times 1.50) = 8 \times 75.00 = \text{AED } 600.00$$

Total Overtime Pay Due

$$\text{Total Overtime} = 750 + 450 + 600 = \mathbf{\text{AED } 1,800.00}$$

This AED 1,800 must be itemized separately on your monthly WPS pay slip and deposited alongside your regular monthly salary.

4. The 2-Hour Daily Limit & Exempt Roles

Under Article 19(4), overtime work is capped at 2 hours per day, establishing a strict 10-hour maximum workday ceiling. Working beyond 10 hours is illegal unless necessary to prevent severe material loss, technical malfunction, or safety hazards.

Who is Exempt from Overtime?

Under the Executive Regulations of the UAE Labour Law, the following categories are legally exempt from overtime claims:

  • Senior Management: General Managers, Managing Directors, and Department Heads who exercise administrative and supervisory power.
  • Maritime Crews: Workers aboard oceangoing and commercial vessels.
  • Special Shift Operators: Certain municipal and continuous technical shifts governed by separate ministerial decrees.

If you are an engineer, analyst, specialist, developer, accountant, or corporate professional, you are fully entitled to statutory overtime compensation.
